A £250 motorcycle reservation temporarily holds a motorcycle but does not, by itself, form the final motorcycle sales contract. The final contract is formed through the applicable order form, sales agreement or written acceptance.
Nothing in these terms removes or limits the legal rights of a consumer when goods are faulty, misdescribed or services are not performed with reasonable care and skill.
WHO THESE TERMS APPLY TO: These terms mainly apply to consumers purchasing for personal use. Tell MotoEbikes before ordering if you are buying wholly or mainly for a trade, business, craft or profession, as separate business terms may apply.

ACCEPTING THESE TERMS
By using the website, creating an account, making a reservation, placing an order or booking a service, you agree to the sections of these terms relevant to that activity.
A transaction may also be governed by a vehicle order form, sales agreement, finance agreement, workshop authorisation, test-ride declaration, manufacturer warranty or another document provided before the contract is formed. Mandatory law takes priority. A specific written term agreed for a particular transaction takes priority over these general terms where the two cannot reasonably be read together.

AGE AND ELIGIBILITY
You must be at least 18 years old to place an online order, reserve a motorcycle, apply for or enter into finance, book a test ride or enter into a contract with MotoEbikes.
A parent or legal guardian must make any purchase intended for a rider under 18 and remains responsible for selecting an age-appropriate product, supervising its use and ensuring that it is used only where lawful and safe.

ACCEPTABLE WEBSITE USE
You may use the website for lawful research, shopping and communication with MotoEbikes. You must not:
- use the website for fraud, unlawful activity or infringement of another person’s rights;
- introduce malicious code or attempt to bypass security or access controls;
- interfere with the website, checkout, servers or another user’s experience;
- scrape or extract substantial website content or customer information without permission;
- impersonate another person or submit false payment, identity, registration or finance information;
- use automated systems to place abusive, speculative or excessive orders; or
- use MotoEbikes content in a misleading way or to suggest an unauthorised relationship.
MotoEbikes may restrict access where reasonably necessary to protect the website, customers or another person. This will not affect an existing contractual or statutory right.

CUSTOMER ACCOUNTS
You must provide accurate account and contact information, protect your login details and tell MotoEbikes promptly if you suspect unauthorised access.
MotoEbikes may suspend or close an account where there is reasonable evidence of fraud, security risk, abusive conduct or a serious breach of these terms. Information and access required to fulfil orders, resolve complaints and meet legal obligations will be preserved.

PRODUCT INFORMATION, IMAGES AND PERFORMANCE FIGURES
MotoEbikes takes reasonable care to describe products accurately. Images, videos, colours and finishes may appear different because of lighting, photography, display settings, model-year changes and manufacturer updates.
Unless confirmed as a contractual specification, range, speed, power, charging time, weight and performance figures are manufacturer figures or reasonable estimates. Actual results can vary according to rider weight, temperature, battery condition, riding mode, terrain, speed, tyre pressure, accessories and maintenance.
A minor manufacturer change that does not materially reduce quality, function or value may mean the supplied product differs slightly from earlier imagery. MotoEbikes will seek your agreement before making a material substitution.

ORDERS AND WHEN A CONTRACT IS FORMED
Website product listings are invitations to place an order. By submitting an order, you offer to buy the stated products on these terms.
An automated acknowledgement confirms receipt but does not necessarily mean acceptance. For parts, accessories, clothing and similar goods, a contract is formed when MotoEbikes sends written acceptance or dispatch confirmation, whichever occurs first.
For a motorcycle, the final sales contract is formed when MotoEbikes accepts the applicable vehicle order form or sales agreement and any stated payment or documentation requirements have been met. A reservation acknowledgement is not final acceptance of a motorcycle sale.
If MotoEbikes cannot accept an order, it will explain this and release or refund any payment for the unaccepted order. Reasons may include lack of stock, inability to deliver, failed payment or identity checks, an obvious pricing error, legal restrictions or reasonable fraud concerns.

£250 MOTORCYCLE RESERVATIONS
A £250 reservation payment temporarily holds the identified motorcycle, subject to availability and the reservation confirmation. The reservation payment alone does not form the final motorcycle sales contract.
Unless a different period is stated in writing, MotoEbikes will contact you to agree the next steps, documentation, finance arrangements and balance payment. If you do not respond within a reasonable time after reminders, MotoEbikes may release the motorcycle after notice and refund the reservation less only any fair, agreed and irrecoverable cost.

PRICES, VAT AND PAYMENT
Consumer prices include VAT unless clearly stated otherwise. Delivery, registration, personalised registration, accessories, workshop work and optional charges are included only where shown in the order, quotation or sales agreement.
Available payment methods may change and are shown at checkout, by payment link or in the showroom. Payments are processed by the provider shown at the point of payment. You must be authorised to use the selected payment method.
If a price is obviously incorrect and could reasonably have been recognised as an error, MotoEbikes may contact you before acceptance to offer the correct price or reject the order and refund any payment. If a non-obvious error is discovered after a contract has formed, MotoEbikes will discuss a fair and lawful resolution rather than simply imposing a higher price.
Finance figures are illustrations unless stated otherwise. Approval, deposit, term, interest rate and total amount payable depend on the lender’s assessment and the signed credit agreement.

AVAILABILITY, FRAUD CHECKS AND ORDER LIMITS
Stock status and expected arrival dates are updated in good faith but may change because of supplier, transport or system delays. MotoEbikes will tell you if an accepted order is materially delayed or unavailable and explain the available options.
MotoEbikes may apply reasonable quantity limits, prevent duplicate or abusive orders and reject orders that appear fraudulent, unlawful or intended for unauthorised resale.
MotoEbikes may request proof of identity, address, payment authority or ownership where reasonably required for fraud prevention, vehicle registration, finance, part exchange or legal compliance.

DELIVERY AND COLLECTION
MotoEbikes currently supplies and delivers within the United Kingdom. Availability, timing, cost and access requirements will be shown before the contract is formed or confirmed in writing.
MotoEbikes will deliver within the agreed period. Where no delivery time has been agreed, consumer goods will normally be delivered without undue delay and no later than 30 days after the contract is formed, unless another period is agreed.
You must provide a safe, accurate and accessible delivery location and disclose relevant restrictions. MotoEbikes may charge a reasonable additional cost caused by inaccurate information or a failed delivery for which you are responsible, after explaining the charge.

OWNERSHIP AND RISK
For a consumer delivery, risk of accidental loss or damage normally passes when you, or a person you nominate other than the carrier, takes physical possession of the goods.
Ownership of goods purchased directly from MotoEbikes passes when full cleared payment is received, unless the law or a written agreement provides otherwise.
Where a motorcycle is financed, ownership and security rights are governed by the finance agreement. You may possess and use the motorcycle without owning it outright until the finance agreement is completed.

ROAD-LEGAL AND OFF-ROAD USE
Road-legal status depends on the exact model and variant, its registration, equipment, condition, modifications and applicable law. You are responsible for holding the correct licence or entitlement and ensuring that tax, registration, insurance, number plates, protective equipment and other legal requirements are satisfied before road use.
Motorcycles sold as off-road only must not be used on public roads, pavements or other places where road traffic law applies. They must be used only on suitable private land with the landowner’s permission or at an authorised venue.
Do not remove required road equipment, de-restrict, tune or modify a motorcycle for road use unless the change is lawful, documented and does not invalidate registration, insurance or warranty arrangements.
Electric motorcycles can produce immediate torque. Riders should wear an approved helmet and suitable protective clothing, ride within their ability and follow the manufacturer’s instructions.

VEHICLE REGISTRATION, DOCUMENTS AND PERSONALISED REGISTRATIONS
You must provide complete and accurate identity, address, licence, insurance and registration information where requested. MotoEbikes is not responsible for delays or additional costs caused by incorrect, incomplete or late information supplied by you.
Do not use a road-legal motorcycle until registration, insurance, number-plate and licence requirements have been completed. Estimated DVLA or third-party processing times are not guaranteed by MotoEbikes.
A personalised registration acquired or processed at your request may involve separate third-party terms and irrecoverable costs once work has begun. Applicable charges will be explained before the order is placed. Cancellation rights are detailed in the Returns, Refunds & Cancellations Policy.

TEST RIDES
Test rides are subject to availability, weather, insurance requirements, staff assessment and completion of the test-ride process. You must be at least 18, provide requested identification and hold the appropriate valid licence or entitlement for the motorcycle and location.
You must follow staff instructions, wear required protective equipment and disclose information reasonably relevant to safe participation. Health or accessibility information is requested only where voluntarily provided or reasonably needed to arrange the ride safely.
MotoEbikes may postpone or refuse a test ride where there is a reasonable safety, legal, insurance or conduct concern. Responsibility for loss or damage will be determined under the test-ride agreement and applicable law. Nothing excludes responsibility where it cannot legally be excluded.

WORKSHOP, SERVICING AND REPAIRS
A quotation is an estimate unless expressly stated to be fixed. Diagnostic work may reveal additional faults or parts requirements. MotoEbikes will seek your approval before carrying out material additional chargeable work.
By authorising workshop work, you permit reasonable inspection, diagnostics, charging, software checks and controlled testing needed to assess or verify the repair, including a lawful road or premises test where reasonably necessary and insured.
You must disclose relevant modifications, previous repairs, accident damage, battery concerns and security devices. MotoEbikes is not responsible for a defect caused by inaccurate or withheld information, an unrelated pre-existing fault or work performed by another person, but remains responsible for its own work.
Workshop services will be performed with reasonable care and skill. Service cancellation and consumer remedies are explained in the Returns, Refunds & Cancellations Policy.

FINANCE AND INSURANCE REFERRALS
MotoEbikes Ltd is an Appointed Representative of The Compliance Guys Ltd, which is authorised and regulated by the Financial Conduct Authority. MotoEbikes acts as a credit broker, not a lender, and may introduce customers to a limited panel of finance providers.
Finance is subject to status, affordability, lender approval and the lender’s terms. An introduction is not impartial because MotoEbikes has commercial relationships with providers and may receive commission. The relevant disclosure and finance documents will explain the arrangement before you enter into an agreement.
MotoEbikes may provide a link to Bikesure or another insurance provider. Unless expressly stated otherwise, you enter your information directly with that provider, which supplies its service under its own terms and privacy notice. MotoEbikes does not guarantee insurance availability, price or cover.

PART-EXCHANGE MOTORCYCLES
A part-exchange valuation is based on the information and condition available at the time and may be revised after physical inspection where the motorcycle differs materially from its description.
You confirm that you own the motorcycle or are authorised to dispose of it and have disclosed outstanding finance, accident history, mileage, modifications, faults, theft markers, write-off status and other information that would materially affect value or lawful transfer.
The vehicle order or part-exchange document will explain how value, outstanding finance and transfer are handled. If the connected purchase is lawfully cancelled or rejected, treatment of the part exchange is set out in the Returns, Refunds & Cancellations Policy.

WARRANTIES AND STATUTORY RIGHTS
Manufacturer and commercial warranty periods, covered components, servicing requirements and exclusions vary by brand, model and product. The warranty information supplied with the product or confirmed in the sales documents applies to that commercial warranty.
A manufacturer or distributor may administer a commercial warranty claim, and MotoEbikes may help with the process. This does not remove MotoEbikes’ legal responsibilities as the retailer or reduce your statutory rights.
Commercial warranties may exclude fair wear, consumables, accident damage, neglect, competition use, misuse, unauthorised modification or failure to follow servicing and care instructions, but an exclusion applies only according to the actual warranty terms and does not override consumer law.
Original packaging may help with safe transport but is not a condition of exercising a statutory right. Contact MotoEbikes before transporting a motorcycle or lithium-ion battery.

CANCELLATIONS, RETURNS, REFUNDS AND FAULTY GOODS
Cancellation and return rights depend on how the contract was made, the product or service involved and whether there is a fault. Distance purchases will normally carry a statutory cancellation period, subject to exceptions. Showroom purchases do not carry an automatic change-of-mind right, although MotoEbikes offers a goodwill return for certain smaller unused goods.

REVIEWS, PHOTOGRAPHS AND CUSTOMER CONTENT
Content you submit must be honest, lawful, relevant and your own, or used with the rights holder’s permission. It must not be defamatory, threatening, discriminatory, deceptive, infringing or contain another person’s private information without permission.
Where you submit content for publication, you give MotoEbikes a non-exclusive, worldwide, royalty-free licence to host, reproduce, edit for length or format, display and promote that content in connection with MotoEbikes. You retain ownership and may ask MotoEbikes to stop future use, although records required for legal, complaint or evidential purposes may be retained.
MotoEbikes may moderate or decline content but does not promise to publish every submission. Sponsored or incentivised content will be identified where required.

INTELLECTUAL PROPERTY
The MotoEbikes name, website design, original text, photographs, video, graphics and other original material are owned by or licensed to MotoEbikes and protected by intellectual-property law.
You may view, print or save reasonable extracts for personal, non-commercial use. You must not reproduce substantial content, remove ownership notices, republish product images, create misleading advertising or use MotoEbikes branding without permission.
You may link fairly and lawfully to public website pages provided the link does not imply endorsement, partnership or approval that does not exist and does not frame or obscure the source page.

THIRD-PARTY WEBSITES AND SERVICES
The website may link to manufacturers, finance providers, Bikesure, social networks, maps, video platforms, payment providers and other third-party services.
A third party controls its own website and service and applies its own terms and privacy notice. MotoEbikes is responsible for its own statements and introductions but is not responsible for the independent content, availability, decisions or performance of a third-party service, except where the law makes MotoEbikes responsible.

PRIVACY, SECURITY AND COOKIES
Personal information is handled in accordance with the Privacy Policy. Cookie and tracking choices are explained in the Cookie Policy and through the store’s cookie controls.
Payment-card information is processed by the applicable payment provider. MotoEbikes takes reasonable security measures, but no internet service can promise absolute security. Tell MotoEbikes promptly if you suspect unauthorised account or payment activity.

RESPONSIBILITY AND LIABILITY
Nothing in these terms excludes or limits responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights, or another liability that cannot legally be excluded or limited.
MotoEbikes is responsible for loss or damage that is a foreseeable result of breaching a contract or failing to use reasonable care and skill. A loss is foreseeable if it was obvious or both parties knew it might happen when the contract was formed.
MotoEbikes is not responsible for loss that was not foreseeable, for loss caused by unlawful or unsafe use, or for a failure caused by inaccurate information, unauthorised modifications, misuse or work by another person, except to the extent MotoEbikes contributed to the loss.
If you are a consumer, MotoEbikes does not accept responsibility for business losses such as lost profit, lost revenue, interruption or lost opportunity arising from a product bought mainly for personal use. This does not affect rights that cannot legally be limited.

EVENTS OUTSIDE REASONABLE CONTROL
MotoEbikes is not responsible for delay or failure caused by an event outside its reasonable control, such as severe weather, transport disruption, supplier failure, industrial action, public-authority action, utility failure, cyber incident or manufacturer recall.
MotoEbikes will contact you as soon as reasonably possible, take reasonable steps to reduce the effect and explain your options. Your right to cancel or obtain a refund where the delay is substantial or the contract cannot be performed is not removed.

CHANGES TO THESE TERMS AND THE WEBSITE
MotoEbikes may update the website, products and these terms to reflect legal, regulatory, technical or business changes. The terms in force when a contract is formed will normally govern that contract.
A later change will not retrospectively remove an existing contractual or statutory right. Where a change must affect an ongoing service, MotoEbikes will give reasonable notice where practicable and explain any right to object or cancel.

GOVERNING LAW AND SEVERABILITY
These terms and contracts with MotoEbikes are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections provided by the law of your home jurisdiction and may use the courts available to you under applicable law.
If any part of these terms is found unlawful or unenforceable, the remaining parts continue to apply. A delay in enforcing a right does not mean that right has been waived.
